Truck driver alleges wrongful termination following wrist injury

A man claims he was terminated from his employment after seeking workers compensation benefits following a wrist injury.

Plaintiff Kevin B. Cook Jr. filed the lawsuit in the Madison County Circuit Court against Terminal Transport Inc., Transport Leasing/Contract, Inc., Payroll Plus Corporation, The Labor Source Inc. and the TLC Companies.

According to the complaint, Cook experienced a pop in his wrist while cranking up a trailer on September 14, 2023. He was later diagnosed with a ganglion cyst and carpal tunnel syndrome in his right upper extremity, which he attributes to his work activities.

Cook reported his injury to his employer and expressed intent to assert his rights under the Illinois Workers’ Compensation law. However, he alleges that he was wrongfully terminated from his job on November 15, 2023, in retaliation for asserting those rights. As a result of this termination, Cook claims he has suffered damages including loss of wages and employment benefits as well as emotional pain and suffering.

The plaintiff is seeking compensatory damages in excess of $50,000 plus court costs.
