Sleeping truck driver in parked tractor trailer alleges injuries from collision

A truck driver claims another truck driver drove too close to his parked rig at Love’s Travel Stop, causing a collision.

Plaintiff Joseph Heist of Gainesville, Mo., filed the complaint in the Madison County Circuit Court against Kazim Kapushev and Russo Brothers Transportation Inc. Russo Brothers, which is located in Rockdale, Ill., is named as a defendant as Kapushev’s employer.

According to the complaint, Heist claims he was parked and asleep in his truck on Sept. 19, 2021, at 1 a.m. in Searcy, Ark., when he was struck by a truck driven by Kapushev, of Brooklyn, N.Y. Heist alleges Kapushev was traveling too fast and too close to his truck, causing the defendant to hit the side of Heist’s vehicle.

Heist claims he was “severely injured including his back and legs and body as a whole.” As a result, Heist allegedly lost wages and experienced “loss of enjoyment of life.”

Heist seeks a judgment that is fair and reasonable, plus court costs and all other relief the court deems just.
