Shopper alleges cart corral collapsed on him at O’Fallon Walmart

A shopper is suing an O’Fallon Walmart claiming he was injured when a cart corral allegedly collapsed on him.

Plaintiff Anthony Deberry filed the lawsuit in the St. Clair County Circuit Court against Wal-Mart Inc., also known as Walmart Supercenter, citing negligence.

According to the lawsuit, Deberry was a patron at a Walmart store in O’Fallon on Sept. 27, 2021. He claims that after he was done shopping, he was returning his shopping cart to the cart corral when it suddenly collapsed on him, causing him to suffer serious injuries.

Deberry alleges the defendant negligently failed to provide a safe environment to protect the safety of its customers by failing to inspect and maintain the cart corral and failing to provide warning of the dangerous condition of the cart corral.

Deberry states that as a result of the defendant’s negligence, he has sustained severe and permanent injuries to his knee, which required him to go to the hospital for treatment. He claims he has experienced pain and suffering and that his injury will impact his ability to enjoy normal life. He adds that he has incurred significant medical expenses and will continue to require the services of medical staff to recover.

The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper.
