Tenant alleges injuries when apartment balcony collapsed

A tenant claims he was injured when his apartment balcony collapsed because it was not properly attached to the building.

Brandon Sargent filed a complaint April 18 in the Madison County Circuit Court against Rigoni Properties LLC, alleging premises liability and negligence.

According to the complaint, Sargent was standing on the second rear exterior balcony at the defendant’s apartment complex on March 20. He claims the balcony broke off from the building, collapsed and caused him to suffer injuries.

Sargent claims Rigoni was negligent for failing to have a secure and safe balcony, failing to hire a competent contractor, failing to inspect and repair the dangerous condition and for failing to warn of the dangerous condition. He also claims Rigoni had actual or constructive knowledge of the hazard but failed to repair or remedy the balcony, which was not properly fastened to the outside of the building.

Sargent seeks monetary relief of more than $50,000 and all other just relief.
