Suit alleges tractor trailer driver ran red light, caused collision

A motorist and passenger claim the driver of a tractor trailer ran a red light and caused a collision.

Misty D. Robertson and Dean A. Robertson filed a lawsuit in the Madison County Circuit Court against Tazco Soil Service Co. doing business as Earlybird Feed and Fertilizer, Pyles Trucking Co. and Darrell D. Matthews Jr., alleging negligence and loss of consortium.

According to the lawsuit, the plaintiffs were stopped at a red light at an intersection and waiting to make a left turn onto Illinois Route 162 on June 28, 2021. They claim Matthews was operating a tractor with an attached trailer traveling west – southwest on Illinois state route 162 when he allegedly ran the red light and caused a collision with the plaintiffs.

The plaintiffs allege Matthews was negligent in failing to keep a proper lookout, failing to keep the vehicle under control, operating a vehicle at an unreasonable and unsafe speed, failing to reduce speed to avoid a collision, operating a vehicle while distracted and failing to obey a traffic control signal.

The Robertsons claim they were caused to suffer severe injuries, endure pain, suffering and disability, incurred medical expenses, lost wages, diminished earning capacity and suffered loss of enjoyment of a normal life.

The plaintiffs seek a judgment in excess of $50,000, plus court costs, pre-judgment interest and all other relief deemed just and proper.
