Former Nu Way Concrete Forms employee alleges retaliation for seeking worker’s compensation benefits

A former employee of Nu Way Concrete Forms in Troy claims that he was fired for seeking worker’s compensation benefits after being injured in the job.

Plaintiff Shaun Sunfield filed the lawsuit in the Madison County Circuit Court against Nu Way Concrete Forms Troy, LLC, citing retaliatory discharge.

According to the lawsuit, Sunfield was formerly employed by Nu Way Concrete Forms Troy, LLC as a warehouse manager. Sunfield states that on April 28, he was terminated for an incident involving “dead inventory.” However, he claims he was actually terminated in retaliation for filing a worker’s compensation claim after being previously injured on the job.

Sunfield is seeking damages for lost income and benefits, humiliation, mental anguish and losses incurred while seeking other employment in excess of $50,000, plus court costs and any other relief the court deems proper.
